The Department of Health and Human Services recently released guidance that set forth a change in enforcement priorities for the agency, outlining HIPAA protections for whistleblowers reporting the provision of gender-affirming care for minors.

While the guidance reiterates long-established HIPAA Privacy Rule protections in a new specific context (gender-affirming care for minors), recent federal government actions that seemingly conflict with the guidance may create confusion for providers and patients—and leave open questions surrounding HIPAA enforcement.
