The last few years have proved to be a tumultuous time for ESG. Many states have implemented inconsistent laws that explicitly prohibit, restrict, or require ESG considerations in decision-making around investments, insurance, contracting, and more.
A recent survey of in-house counsel indicates that the term “ESG” may have fallen out of favor as many companies revisit how they discuss their environmental and social initiatives internally and with consumers and investors.
