Conflicting cases on whether drivers for ride services are exempt from arbitration as interstate transport workers are before two federal appeals courts. If upheld, drivers and ridesharing companies might both ask the U.S. Supreme Court to resolve the circuit split.
If drivers are not exempt from arbitration, the best option for plaintiffs’ attorneys to keep class action lawsuits in the courts may be to narrow the class of drivers to those living, or choosing to work, near airports and travel hubs. But this tactic may leave drivers in rural areas out of court.
