In case there was any doubt about best practices for cookie consent, the U.K. Information Commissioner’s Office (ICO) recently issued new guidance on the use of cookies that merits close attention by webmasters of all stripes—including those maintaining law firm websites.
As noted in my earlier piece, only 48% all Am Law 200 firms are actively soliciting cookie consent from website visitors via pop-up banners. And of those that use such banners, nearly 75% rely on implied consent. Those percentages would not sit well with the ICO, which busts the “implied consent myth” along with other common practices.
