The US Supreme Court has returned a case to the Second Circuit to determine what should happen with a hike in US Trustee’s quarterly fees that was deemed unconstitutional in a prior case.
The US Trustee, the Justice Department’s bankruptcy watchdog, petitioned after the US Court of Appeals for the Second Circuit ruled that Clinton Nurseries has to be reimbursed for the heightened fees it paid as a Chapter 11 debtor. On Tuesday the justices vacated and remanded the ruling back to the circuit court.
