A Sunnova Energy subsidiary and lender group accused the solar giant of violating a court-approved asset purchase agreement, claiming the dispute is delaying completion of thousands of solar systems and payments to dealers.
Sunnova refused to transfer 2,692 systems that were already sold under the agreement approved in June, Sunnova TEP Holdings and the Atlas SP Partners lender group, which financed Sunnova’s acquisition of systems, argued in a motion filed Wednesday in the US Bankruptcy Court for the Southern District of Texas.
