A debtor could compel a Chapter 7 trustee to abandon property that had garnered “significant” equity after the filing of a bankruptcy petition, a Kentucky bankruptcy judge ruled (In re Coslow, 2017 BL 263583, Bankr. W.D. Ky., No. 16-3096, 7/28/17).
The value of a debtor’s residence and related liens would be considered as of the bankruptcy filing date for determining whether the trustee would be compelled to abandon the property, effectively returning it to the debtor.
