Sears Owner Loses Mall of America Lease Supreme Court Fight (3)

Transform Holdco LLC, an Eddie Lampert-owned shell company that bought the Sears department store chain out of bankruptcy, lost a US Supreme Court fight over the Minnesota-based Mall of America’s attempt to get back the department store’s $10-a-year lease that was included in the sale.

In a unanimous decision Wednesday, the justices found that a district court has jurisdiction to review Mall of America’s challenge of the lease transfer that was part of Transform’s 2019 acquisition of Sears Holdings Corp.'s assets.
