Sanction Imposed by Another Court Doesn’t Mitigate Discipline for Same Conduct

The fact that a bankruptcy court disciplined a lawyer for assisting a disbarred attorney’s unauthorized practice of law is not a mitigating factor in determining what sanction the lawyer should receive for the same misconduct in a disciplinary proceeding, the Georgia Supreme Court ruled June 16 (In re Tucker, 2014 BL 165444, Ga., S14Y0413, 6/16/14).

In light of other mitigating circumstances, a six-month suspension rather than disbarment is the appropriate sanction for the lawyer’s violations, the court concluded in a per curiam opinion.
