Saint-Gobain Unit Defeats Asbestos Claimants’ Effort to Litigate

A pair of asbestos claimants lost their bid to pursue legal action against a US-based subsidiary of France’s Compagnie de Saint-Gobain when the Fourth Circuit declined to lift a litigation pause in the unit’s bankruptcy.

The 2-1 ruling, which affirmed a May 2024 decision from the US Bankruptcy Court for the Western District of North Carolina, focused on the asbestos claimants’ lack of evidence to support their allegation that the DBMP LLC bankruptcy was filed in bad faith because an asbestos claims provision of bankruptcy law was invoked.
