The US Supreme Court will consider whether an insurer had standing to challenge an asbestos bankruptcy plan that lower courts determined did not affect the insurer.
The high court will take up the Fourth Circuit’s February finding that Truck Insurance Co. couldn’t challenge Kaiser Gypsum Co. Inc.'s bankruptcy plan because the plan didn’t change the insurer’s rights or responsibilities. The court also said that Justice Samuel Alito “took no part in the consideration or decision of this petition.”
