Johnson & Johnson Talc Litigants Urge Judge to Reconsider Venue

Johnson & Johnson’s court win allowing it to keep its talc subsidiary bankruptcy proceeding in Texas needs to be revisited, a group of plaintiffs’ attorneys said, arguing the affiliate isn’t different from the one that was previously in bankruptcy in New Jersey.

J&J’s Red River Talc LLC isn’t a separate corporate entity from LTL Management LLC, the plaintiffs said in a Wednesday filing in the US Bankruptcy Court for the Southern District of Texas. The Red River bankruptcy, like LTL’s before it, aims to resolve tens of thousands of claims that the company’s talc-based products, including baby powder, caused cancer. ...
