A bankruptcy judge denied a request by Imerys Talc America Inc. to install its chosen agent to represent future tort claimants for its Italian unit.
Judge Laurie Selber Silverstein of the US Bankruptcy Court for the District of Delaware said in a letter order Monday that Imerys Talc Italy SPA can’t use James L. Patton Jr. of Young Conaway Stargatt & Taylor LLP as its future claims representative because he already serves in that role for Imerys Talc America itself. She noted that the Italian operating affiliate is distinct from the North American company.
