Homeowner Scores Partial Appeals Court Win Against Bankrupt HOA

A federal district court has been ordered to reexamine a homeowner’s request that a bankruptcy court abstain from ruling on a state-law fight between the Florida resident and her homeowners association.

The US District Court for the Middle District of Florida’s order tossing homeowner Alice Guan’s appeal against the nonprofit Ellingsworth Residential Community Association Inc. was partially vacated and remanded, according to a published opinion issued Monday by the US Court of Appeals for the Eleventh Circuit.
