A Georgia-Pacific unit’s asbestos claimants could get another crack at dismissing the company’s liability-limiting bankruptcy after a judge cleared the way for a direct appeal to the Fourth Circuit.
A decision from the appellate court could help advance the six-year old bankruptcy of Georgia-Pacific affiliate Bestwall LLC and provide an answer to a question of public importance, Judge Laura T. Beyer of the US Bankruptcy Court for the Western District of North Carolina said in a bench ruling Thursday. Her ruling speeds up the process by skipping over a federal district court, where bankruptcy appeals typically are handled.
