A $31 million default judgment against former NASCAR team owners wasn’t an abuse of a bankruptcy court’s discretion, a federal appeals court held, saying the owners had a “blatant disregard for the judicial process.”
The discovery sanction against Ronald Devine and his wife Brenda Devine was proper after they “deployed a strategy of obstruction and delay,” during their team’s bankruptcy proceedings, the US Court of Appeals for the Fourth Circuit said in a published opinion Friday affirming a district court ruling.
