Ex-Talc Supplier’s Bankruptcy Battle Highlights Circuit Split

Defunct talc supplier Whittaker, Clark & Daniels Inc. defended its bankruptcy against talc claimants who say it’s improper, bringing a circuit split over jurisdiction to the forefront of the dispute.

The company’s lawyers argued before the US Court of Appeals for the Third Circuit on Tuesday that it should be permitted to move its Chapter 11 case forward to resolve, via a $535 million settlement, lawsuits claiming its talc contained cancer-causing asbestos.
