The former CEO of the fallen tech boot camp Prehired violated a bankruptcy shield rule when he sued the company’s Chapter 7 trustee without obtaining a court’s permission, a judge concluded.
Judge Thomas M. Horan of the US Bankruptcy Court for the District of Delaware held in a May 30 opinion that former executive Joshua Jordan should have sought court leave before suing trustee Don Beskrone in a federal district court, as required under the “Barton doctrine.”
