The Justice Department’s bankruptcy arm subpoenaed Brian Kahn, the ex-CEO of bankrupt brand manager Franchise Group Inc., to turn over records related to his interactions with law firm Willkie Farr & Gallagher LLP.
The US Trustee’s subpoena issued to the controversial executive comes as the bankruptcy watchdog unit seeks to disqualify Willkie from representing Franchise Group in its Chapter 11 case. The US Trustee argued that the firm helped investment adviser B. Riley Financial Inc. and Kahn in a 2023 buyout that’s become a central issue for creditors in the bankruptcy.
