Doctors Sue Steward in Bankruptcy Court Over Compensation Plans

A group of doctors filed a proposed class action against Steward Health Care System LLC regarding compensation plans, aiming to protect the funds from the private health network’s bankruptcy estates.

The doctors, beneficiaries of Steward’s deferred compensation plans, contest whether the plans qualify as “top-hat plans” under the Employee Retirement Income Security Act, according to a complaint filed Monday in the US Bankruptcy Court for the Southern District of Texas.

ERISA establishes standards for most voluntarily established retirement and health plans in the private sector. The “top-hat plans” are employer-sponsored plans for a select group of highly compensated employees.
