A group of minority lenders for Del Monte Foods Corp. II lost its bid for a direct appeal of the canned food company’s bankruptcy settlement to the Third Circuit after a judge found it didn’t meet the statutory requirements.
The group’s request is based on facts of the case rather than a question of law, Judge Michael B. Kaplan of the US Bankruptcy Court for the District of New Jersey wrote in a Thursday decision.
