Credit One Fights Bankruptcy Discharge Violation Class Action

Credit One Bank NA asked a New York federal judge to dismiss a nationwide class action for violating consumer bankruptcy discharge rights, saying the suit exceeds what a bankruptcy court can decide.

The Las Vegas-based consumer banking company is looking to undercut a complaint filed shortly after the US Bankruptcy Court for the Southern District of New York ruled late last month that declaratory relief can be provided to a nationwide class of individuals who went through bankruptcy but didn’t get the full benefit of a clean financial slate.
