A defendants’ motion to dismiss an adversary complaint in which a Chapter 7 trustee was serving as the intervenor plaintiff was denied June 14 by the U.S. District Court for the Southern District of Ohio (Redhawk Global LLC v. World Projects Int’l Inc., S.D. Ohio, 2:11-cv-00666-EAS-MRA, 6/14/13).
Judge Edmund A. Sargus Jr. found that the court did in fact have personal jurisdiction over the defendants because the court had subject matter jurisdiction over the proceeding under the Bankruptcy Code, and Rule 7004 of the Federal Rules of Bankruptcy Procedure allows for nationwide service of process.
