City of Chester Wants State Supreme Court to Weigh Utility Sale

The bankrupt city of Chester, Pa., is backing a bid by a litigation adversary to get the Pennsylvania Supreme Court to review a ruling that’s favorable to the city.

The US Bankruptcy Court for the Eastern District of Pennsylvania, where Chester is in Chapter 9, should lift the bankruptcy-imposed stay on commonwealth-court litigation so the city can get a final answer on whether it can sell the Chester Water Authority’s assets. The bankruptcy court should lift the stay so an appeal by the CWA can go forward, the city said in a Thursday filing.
