A wrongful death action was remanded back to state court by the U.S. District Court for the Middle District of Louisiana after one of the defendants, who was also a Chapter 11 debtor, was dismissed from the case (Adelsflugel v. Consol. Aluminum Corp., M.D. La., 3:13-cv-00811-JJB-RLB, 8/20/14).
Judge James J. Brady found that remand was warranted on the grounds of the permissive abstention doctrine and equitable remand.
