Restaurant manager East Coast Foods Inc. doesn’t have standing to sue its former Chapter 11 trustee for actions taken during the bankruptcy, an appeals court ruled.
The US Court of Appeals for the Ninth Circuit on Friday affirmed a decision from its bankruptcy appellate panel, which upheld a California bankruptcy court’s dismissal of the company’s complaint due to lack of standing.
East Coast Foods, a manager of locations of Roscoe’s House of Chicken & Waffles, filed for bankruptcy in 2016. Its reorganization plan established a trust to pursue litigation, overseen by a plan trustee.
