TransUnion, Executive Must Face CFPB Deceptive Marketing Lawsuit (1)

The Consumer Financial Protection Bureau can continue a lawsuit alleging TransUnion and a former top executive violated a 2017 settlement over deceptive marketing and sales practices by selling subscription-based credit monitoring services.

Judge Elaine E. Bucklo of the US District Court for the Northern District of Illinois on Nov. 18 denied motions to dismiss filed by TransUnion and John Danaher, a former executive who previously led TransUnion Interactive.

The two defendants failed in their argument that the CFPB was required to provide feedback on a compliance plan, and that the claims were time-barred, Bucklo said. The judge also said the ...
