The Justice Department and the Consumer Financial Protection Bureau asked the U.S. Supreme Court to reject a second challenge to the CFPB’s leadership structure.
All American Check Cashing Inc.’s concerns about the constitutionality of the CFPB’s single director leadership structure and for-cause removal protection for the director would be addressed in a case the Supreme Court had already agreed to hear, the two agencies said in a brief filed Nov. 7.
“Granting review in this case would do nothing to enhance the court’s consideration of the issue,” the Justice Department and CFPB brief said.
