Morgan Stanley Unit Seeks Court Order To Block Transfer of Customer Information

Morgan Stanley Smith Barney asked a New York court to bar former advisers from using confidential information to solicit customers for a competitor (Morgan Stanley Smith Barney v. Biondo, N.Y. Sup.Ct., 653131/2014, petition filed 10/15/14).

Morgan Stanley’s petition for a temporary restraining order in aid of arbitration came after customer files went missing from a Jericho, N.Y., branch office after two advisers there resigned and joined a competitor.

Morgan Stanley said one adviser sent client documents to his personal e-mail address in the days leading up to his resignation.
