Fifth Third Loses Bid to Duck Deposit Account Fee Class Suit (1)

Fifth Third Bancorp customers who claim they were charged improper deposit account fees will be able to continue pursuing a proposed class action following a federal judge’s ruling.

The depositors can pursue claims that a $15 fee they were all charged when the bank couldn’t process deposits into their accounts constituted a breach of contract and a deceptive practice, Judge Douglas R. Cole of the US District Court for the Southern District of Ohio said in a Tuesday opinion partially denying dismissal.
