A federal appeals court blocked the transfer of a banking industry lawsuit challenging new caps on credit card late fees from Fort Worth, Texas, to Washington, D.C.
The US Court of Appeals for the Fifth Circuit in a Friday opinion sent the case back to the US District Court for the Northern District of Texas, determining that Judge Mark Pittman didn’t have the authority to send the case to federal district court in Washington.
The suit was brought by the US Chamber of Commerce, the American Bankers Association, and the Consumer Bankers Association, joined by several Texas industry groups.
