Discover Bank Loses Appeal to Send DACA Bias Suit to Arbitration

Discover Bank can’t force a DACA recipient to arbitrate her discrimination claims after previously telling a lower court that she could opt out of a loan arbitration agreement.

The bank also can’t compel the undocumented immigrant into arbitration over a 2010 student loan agreement signed with Citibank NA before Discover acquired ownership of the loan, the US Court of Appeals for the Ninth Circuit ruled Monday in affirming the district court.
