Credit Card Late Fee Challenge Clear to Proceed in Texas Court

Litigation over the Consumer Financial Protection Bureau’s $8 credit card late fee cap can move forward at the district court level after a federal appellate court officially closed out the case weeks early.

The US Court of Appeals for the Fifth Circuit had previously dismissed as moot an interlocutory appeal from the US Chamber of Commerce, the American Bankers Association, the Consumer Bankers Association, and three Texas industry associations seeking to impose a preliminary injunction on the rule, after District Judge Mark Pittman put it on hold.
