A challenge from banks and the US Chamber of Commerce to the Consumer Financial Protection Bureau’s credit card late fee rule will be overseen by a new but equally conservative judge.
Judge Reed C. O’Connor of the US District Court for the Northern District of Texas on Thursday recused himself from the case, according to court filings. O’Connor, a George W. Bush appointee who issued repeated rulings limiting the reach of the Affordable Care Act and other federal laws, didn’t provide a reason for his recusal.
Judge Mark T. Pittman has now been assigned to the case.
