CFPB Takes Second Crack at Encore for Collections Violations (1)

Encore Capital Group Inc., the country’s largest debt collection firm, is facing a Consumer Financial Protection Bureau lawsuit for allegedly engaging in illegal collections practices that the bureau had tried to stop.

Encore and its subsidiaries violated a 2015 CFPB consent order by filing debt collection lawsuits without the appropriate documentation that a consumer owed a debt, according to a complaint filed Tuesday in the U.S. District Court for the Southern District of California. The companies also failed to provide proper disclosures in more than 750,000 cases, it said.
