Bank of America Corp. convinced a federal court to dismiss a lawsuit alleging that the company falsely promised pandemic relief from bank account fees.
But in her Wednesday ruling, Judge Yvonne Gonzalez Rogers of the US District Court for the Northern District of California provided a roadmap to revive the case, saying it wasn’t “implausible that consumers could have been misled by BANA’s alleged representations.”
The plaintiffs failed to prove that the Bank of America, N.A., the Charlotte, N.C.-based company’s retail banking unit, promised to refund all non-sufficient fund, overdraft and other fees if consumers faced coronavirus pandemic-related financial hardships. ...
