Bank of America Gets Narrower Class in Dispute Over ATM Fees

A federal district judge modified the definition of the class in an ATM fee dispute involving Bank of America, excluding individuals who received payment through an earlier settlement.

Judge Dana M. Sabraw of the US District Court for the Southern District of California on Tuesday partially granted the bank its motion for reconsideration of his decision to certify the case as a class action.

While Sabraw agreed to revise the definition of the class to exclude customers who made a claim in the separate “Weiss settlement,” he rejected BofA’s other reconsideration requests.
