The UK’s Upper Tribunal ruled largely in favor of the UK Information Commissioner in an appeal relating to its enforcement against Clearview AI, according to a statement.
- Commissioner fined Clearview £7.5m for scraping images of UK residents and using them for business purposes
- Clearview appealed the fine and enforcement notice to the First-tier Tribunal
- ICO appealed the tribunal’s decision
- Upper Tribunal upheld three of the Commissioner’s four grounds of appeal
- Agreed that Clearview’s processing related to monitoring of UK residents and does not fall outside the reach of UK data protection law
