Texas Child Online Safety Act Needs More Analysis, Judges Say

A panel of appeals court judges likely need more information to evaluate the constitutionality of a Texas law requiring apps and websites to shield children from harmful online content.

Judges James Ho, Dana Douglas, and Patrick Higginbotham of the Fifth Circuit each brought up remanding the case to the trial court to analyze whether the law is unconstitutional across all potential applications, not just some.

The lower court issued injunctions in separate challenges—from a group of students and a trade association representing the biggest names in the tech industry—holding that the law likely chills protected speech.
