AI-Created Political Ad Use Limited by Decades-Old Law, FEC Says

Existing law prohibits political candidates from using artificial intelligence to generate misleading campaign ads that look or sound like their opponents authorized them, the Federal Election Commission said in a notice approved Thursday.

The commission voted 5-1 to say that the Federal Election Campaign Act’s long-standing prohibition against “fraudulent misrepresentation” in certain instances applies to AI and is “technology neutral.” The notice applies to candidates running in the 2024 election.

Vice Chair Ellen L. Weintraub (D) was the only commissioner to vote against the notice.
