Walgreen, Kroger Launch Separate Suit Over Glumetza Generics

Walgreen Co. and three other pharmacy chains sued Bausch Health Cos. in San Francisco federal court Dec. 2 over its alleged scheme to delay generic competition for the diabetes drug Glumetza, separating themselves from a proposed class action that seeks $10 billion.

Walgreen, Kroger Co., Albertsons Cos., and H-E-B LP filed their complaint in the U.S. District Court for the Northern District of California, where the earlier-filed case is also pending. The putative class plaintiffs, led by the city of Providence, R.I., filed a consolidated complaint Nov. 25.
