Suzanne Somers Clears Another Hurdle in QVC Fraud Lawsuit (1)

QVC Inc. lost its bid Tuesday to avoid a trial of fraud and contract claims brought by actress Suzanne Somers, who says the company used catch-and-kill tactics to sideline her dietary supplements, but a federal judge in Philadelphia deferred ruling on antitrust and unfair competition claims.

Judge Chad F. Kenney mostly denied the company’s summary judgment motion in a one-page ruling for the U.S. District Court for the Eastern District of Pennsylvania. Later the same day he rejected a mirror-image motion by Somers, who had sought to win the case without a trial.
