An association lost its bid to revive antitrust claims that a national board monopolized the market for certifying surgical assistants and technicians, as the Tenth Circuit affirmed a lower court’s decision to end the case and held the plaintiff failed to make a key antitrust allegation.
The US Court of Appeals for the Tenth Circuit in a Tuesday opinion said that the Association of Surgical Assistants didn’t allege sufficient evidence that the National Board of Surgical Technology and Surgical Assisting blocked it from competing as a provider of continuing education credits for the medical practitioners.
