The U.S. Supreme Court agreed to review a question from security equipment maker Axon Enterprise Inc. on whether Congress stripped federal district courts of jurisdiction over challenges to the Federal Trade Commission’s structure and procedures when it gave the appeals courts power to affirm or set aside the agency’s cease-and-desist orders.
The court declined to review another of Axon’s questions in the petition pertaining to the substantive issue of whether the FTC’s structure, including for-cause removal protections for its administrative judges, is constitutional.
