Supreme Court Rejects Las Vegas Sun’s Media Markets Appeal

The Supreme Court on Monday denied the Las Vegas Sun’s bid to appeal a Ninth Circuit ruling that found an operating agreement between the newspaper and the owners of the Vegas Review-Journal was unenforceable.

The Las Vegas Sun asked the high court in December to review the decision, arguing that the Ninth Circuit ruling conflicted with how other courts interpret the Newspaper Preservation Act, which carves out a limited antitrust shield for newspapers that combine publishing operations.

The Sun wanted to clarify the scope of antitrust protections in the context of joint newspaper operations.
