Spartan Loses Antitrust Appeal Stemming From Cement Price War

Cement distributor Spartan Concrete Products LLC failed to show that Argos USVI Corp. violated competition rules by taking sides with a rival in a three-year price war in St. Thomas, a federal appeals court affirmed.

Spartan didn’t show that it suffered damages from Argos, a bulk cement vendor, giving rival Heavy Materials a 10% volume discount in violation of the Robinson-Patman Act, the U.S. Court of Appeals for the Third Circuit said July 5.

At trial, Spartan provided unconvincing expert testimony about the business the company lost from the alleged competitive injury, the court said.
