SmileDirectClub LLC persuaded a federal appeals court Tuesday to advance its antitrust challenge to the authority of Georgia’s dental board, scoring a major victory in its multistate fight against regulations that effectively ban the teeth-straightening company’s web-based business model.
The full U.S. Court of Appeals for the Eleventh Circuit upheld a panel ruling last year letting the company move forward with allegations that the dental board targeted SmileDirectClub because it’s made up of practicing dentists looking for a pretext to shut down a competitive threat.
