Saks, Gucci, Prada Notch Win for Luxury No-Poach Pact

Saks Inc. and five luxury fashion houses tentatively defeated federal antitrust litigation over their alleged pledge to refrain from recruiting one another’s retail employees, but a judge indicated the case might be able to proceed with small changes.

Judge Margo K. Brodie dismissed the proposed class action without prejudice Wednesday, saying a former Saks worker can refile her “no poach” claims with more details about the luxury retail labor market. The lawsuit also targets Louis Vuitton USA LLC, Loro Piana & C., Gucci America Inc., Prada USA Corp., and Brunello Cucinelli USA Inc.
