RealPage Failed to Justify Moving US Antitrust Case, Judge Rules

A federal judge rejected RealPage Inc.’s attempt to move the Justice Department’s antitrust case against the software provider to the same forum in Tennessee where it’s litigating similar claims.

The decision leaves Judge Loretta Biggs of US District Court for the Middle District of North Carolina in charge of a case that represents the federal government’s first allegation that an algorithm facilitated harms violating antitrust law.

“RealPage has not provided sufficient factual evidence to show they will suffer more than inconvenience by litigating in this district,” Biggs said in a Dec. 20 order.
