Real Estate Firm Gets Mixed Ruling in Broker Fee Antitrust Case

Hanna Holdings Inc. failed to fully escape claims brought by home buyers who accused the nationwide real estate firm of enforcing anticompetitive rules that led to higher home prices, after a federal judge only granted part of its motion to dismiss.

Judge Wendy Beetlestone of the US District Court for the Eastern District of Pennsylvania in a Tuesday opinion said the plaintiffs lacked standing to pursue injunctive relief under the federal Sherman Act, saying they needed “something more specific and concrete to establish” actual or imminent injury-in-fact. Beetlestone granted the plaintiffs leave to amend that claim and refile.
